By placing an order with hedley enterprises, you confirm that you are in agreement with and bound by the terms and conditions below.

Costing

We will carry out work only where an agreement is provided either by email or, telephone. An ‘order’ is deemed to be a written or verbal contract between hedley enterprises and the client, this includes telephone and email agreements.

hedley enterprises will carry out work only for clients who are 18 years of age or above.

Website Content

You agree to provide any needed information and content required by hedley enterprises in good time to enable us to complete a design or website work as part of an agreed project. The time given to you for production of your website is dependent upon you giving us relevant information, art work and signing of any proofs in time, otherwise our progress will be delayed.

It shall be the responsibility of the client to ensure that all materials presented are free from any third party claims for breach of copyright or license. In the case you provide all the necessary contents for the website within the specified time, we will endeavour to get your site live as soon as possible. Responsibility of final proof reading of website content lies with the client. Changes as a result of an error by hedley enterprises will be corrected free of charge.

Website Updates & Site Maintenance

Ongoing site functionality updates and maintenance are included as part of our hosting service. If your website is hosted with another provider, maintenance is included for the first year after your website launch.

After this period, any maintenance or updates will be charged at our standard hourly rate (or part thereof).

If you’d like to add new material such as extra pages, additional features, or more content than is currently available on your site, this will be treated as a new project — or the time can be deducted from your prepaid maintenance package if you have one in place.

Website Renewals

Fees relating to web hosting or domain names must be paid prior to the expiration date of the service. If the fees remain unpaid at the time of expiration, we will cancel the service and any data held. If a cancelled service is to be reinstated at the Client’s request, a setup fee will be payable before any such reinstatement and any data lost as a result of the cancellation will not necessarily be restored.

Payments

Our web design and development quotes are unique and depend on your requirements.

A deposit will be required before any work is carried out. All deposits are non-refundable. In all cases, website hosting fees and any costs incurred by hedley enterprises on behalf of the client are payable in advance and are non-refundable. Payment terms are 14 days.

If paying by cheque, please allow 5 working days for the cheque to clear.

Invoices are generated 30 or 14 days before the official due date. Payment must be made and cleared by the due date to avoid suspension of your account / service. If no payment has been received your account / service will be suspended after the official due date. If no payment has been made within the following 10 days of the invoice due date(s), we reserve the right to permanently terminate your account / service and all data held.

Copyright

hedley enterprises retains copyright for all website designs and artwork until payment has been received in full. On receipt of payment in full, copyright to the website design and artwork shall be transferred to the client. hedley enterprises reserves the right to take appropriate action if copyright is infringed under the Copyright, Designs and Patents Act 1988.
